By downloading, installing, or using the HappyTime mobile application (“App”), you agree to be bound by these Terms of Use (“Terms”). Your continued use of the App after such modifications constitutes your binding acceptance of the updated Terms.

2. Description of Service

HappyTime provides a gaming utility platform designed to help users:

  • Time Management: Set play time limits, countdown timers, and break reminders.
  • Game Discovery: Access curated game recommendations and links to third-party stores.
  • Mod Management: Access tools to discover and manage third-party game modifications (“Mods”).
  • Statistics: View personal gaming usage history and data visualization.

3. Eligibility and Parental Consent

You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to use this App. If you are under 18, you represent that you have obtained consent from a parent or legal guardian. Parents and guardians are solely responsible for the supervision of their child’s use of the App and for ensuring compliance with these Terms.

4. User Conduct and Restrictions

You agree to use the App only for lawful purposes. You are strictly prohibited from:

  • Illegal Acts: Using the App in any way that violates local or international laws.
  • Technical Interference: Attempting to reverse engineer, decompile, or bypass the security of the App.
  • Malicious Behavior: Distributing viruses, malware, or using the App for “spamming.”
  • Infringement: Using the App to download or distribute Mods that infringe upon the intellectual property rights of game developers or publishers.
  • Service Abuse: Using automated systems (bots, scrapers) to access the App without our prior written consent.

5. Third-Party Content and Game Mods

Important: The App acts as a gateway to third-party content.

  • No Endorsement: We do not own, create, or check the safety of third-party Mods or websites linked within the App.
  • User Responsibility: You acknowledge that downloading or using Mods may violate the End User License Agreement (EULA) of certain games. You assume all risks regarding account bans, software instability, or data loss resulting from the use of third-party Mods.
  • Third-Party Terms: Your interactions with third-party stores (e.g., Google Play, App Store) are governed by their respective terms.

6. Intellectual Property Rights

  • Ownership: All App design, code, logos, and original content are the exclusive property of HappyTime or its licensors.
  • Limited License: We grant you a personal, non-exclusive, non-transferable, and revocable license to use the App for non-commercial purposes.
  • User Content: If you post reviews or content within the App, you grant us a royalty-free, perpetual license to use and display such content.

7. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAPPYTIME DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

IN NO EVENT SHALL HAPPYTIME BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS OR DATA) ARISING OUT OF YOUR USE OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US (IF ANY) IN THE LAST 12 MONTHS.

9. Indemnification

You agree to indemnify and hold harmless HappyTime and its affiliates from any claims, losses, or legal fees arising from: (i) your misuse of the App; (ii) your violation of these Terms; or (iii) your infringement of any third-party rights (including intellectual property rights related to Mods).

10. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

11. Governing Law and Dispute Resolution
